1. Introduction
1.1 These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“the Customer”, “you”, or “your”) and My Check Call Limited (“My Check Call”, “we”, “us”, or “our”) governing the provision and use of our lone worker welfare monitoring and scheduled check-call services (“the Services”).
1.2 By registering for, subscribing to, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms in full.
1.3 If you do not agree to these Terms, you must not access or use the Services.
1.4 These Terms constitute the entire agreement between the parties and supersede all prior agreements, representations, or understandings, whether written or oral.
1.5 Business and Consumer Customers
1.5 These Terms apply to both business customers and individual consumers. Where the Customer is acting as a consumer, nothing in these Terms is intended to exclude or limit any statutory rights that cannot lawfully be excluded or limited under applicable consumer protection legislation.
1.6 Incorporated Documents
1.6 These Terms incorporate by reference any additional policies, guidance documents, notices, or addenda published by My Check Call Limited on its website, including (where applicable) the B2B Addendum for Business Customers and any operational guidance published in the Resources section of the website.
1.7 Such documents form part of the agreement between the Customer and My Check Call Limited and are available at all times via the Resources section of the website.
2. Nature and Scope of the Services
2.1 My Check Call provides a structured welfare monitoring service consisting of scheduled check calls that are logged, monitored, and escalated in accordance with predefined procedures.
2.2 Successful check calls are automatically recorded as completed within the system.
2.3 Where a scheduled check call is not completed, an alert is generated and our operations team will attempt to contact the Customer or subscribed individual. If contact cannot be made, nominated emergency contacts will be contacted in accordance with the escalation procedure.
2.4 My Check Call is not an emergency response service, medical service, rescue service, or alarm receiving centre, and does not guarantee the prevention of injury, loss, harm, or death.
2.5 The Customer acknowledges that the Services are supportive, preventative, and supplementary in nature only and are not a substitute for emergency services, medical care, professional supervision, or statutory duty-of-care obligations.
2.6 Optional Reminder and Support Features
2.6 Certain reminder, prompt, or compliance-support features are available only as optional paid bolt-on services and are not included within standard subscription plans unless expressly stated.
2.7 Where such bolt-on services are not in place, My Check Call accepts no responsibility for missed check calls arising from forgetfulness, distraction, fatigue, or operational oversight.
2.8 The availability of reminder or support features does not remove or reduce the Customer’s responsibility to comply with scheduled check calls.
3. Customer Obligations and Responsibilities
3.1 The Customer shall:
- Provide accurate, complete, and truthful information during registration
- Maintain up-to-date personal and emergency contact details at all times
- Ensure emergency contacts are informed, available, and consent to being contacted
- Ensure their telephone device and service remain active, charged, and operational
- Comply fully with the agreed check-call schedule
3.2 The Customer is solely responsible for the accuracy, completeness, and ongoing validity of all information supplied to My Check Call.
3.3 My Check Call accepts no liability for any failure, delay, or adverse outcome arising from inaccurate, outdated, incomplete, or misleading information provided by the Customer.
3.4 The Customer agrees to fully indemnify and hold harmless My Check Call Limited, its directors, officers, employees, and agents against all losses, claims, damages, liabilities, costs, and expenses arising directly or indirectly from misuse of the Services, missed check calls, inaccurate information, or failure of emergency contacts to respond.
3.5 Rostering and Shift Information
3.5 The Customer is solely responsible for providing My Check Call with accurate, complete, and timely rostering information for each subscribed individual, including but not limited to:
- Full name or unique identifier of the individual on duty
- Shift start and end times
- Scheduled check-call times
- Any substitutions, extensions, cancellations, or amendments
3.6 Rostering information must be provided in advance and within reasonable operational timeframes. Notification of roster changes provided at short notice (including less than 24 hours before a shift unless otherwise agreed in writing) may not be accommodated.
3.7 My Check Call shall not be liable for any failure, delay, missed check call, or escalation issue arising from late, incomplete, inaccurate, or last-minute rostering information supplied by the Customer.
3.8 Where rostering details are not supplied in accordance with this section, My Check Call reserves the right to refuse, suspend, or limit service delivery for the affected shift or period without liability.
3.9 Any loss, harm, delay, or adverse outcome resulting from failures in rostering compliance shall be deemed the sole responsibility of the Customer.
4. Eligibility
4.1 The Services are available only to individuals aged 18 years or over.
4.2 The Customer must have access to a functioning landline or mobile telephone capable of receiving and making calls within the UK.
5. Subscriptions, Billing, and Pricing
5.1 The Services are provided on a rolling monthly subscription basis and are payable in advance via Stripe.
5.2 Subscription plans and optional bolt-on services are detailed on our website and may be amended from time to time.
5.3 By subscribing, the Customer authorises My Check Call to collect recurring payments using the registered payment method.
5.4 Cancellation by the Customer
5.4 Subscriptions may be cancelled by the Customer at any time by providing written notice via email to info@mycheckcall.com. Cancellation shall take effect at the end of the current billing period, and no refunds are provided for any unused portion of a subscription period.
5.5 All prices are stated in GBP and exclusive of VAT. Should My Check Call become VAT-registered, VAT will be applied following a minimum of 30 days’ written notice.
5.6 My Check Call reserves the right to amend pricing with not less than 30 days’ written notice.
5.7 Subscription Allocation
5.7 All subscriptions are provided on a per individual (per person) basis and not per shift, per role, per site, or per schedule.
5.8 Each individual using the Services, whether permanent, temporary, substituted, relief, agency, or ad-hoc, must hold a valid and active subscription in their own name for the duration of their use.
5.9 Individuals without an active subscription are not covered by the Services, and My Check Call accepts no liability for any failure, loss, or incident arising from the use of the Services by unsubscribed individuals.
6. Missed Check Calls and Operational Surcharges
6.1 Compliance with scheduled check calls is fundamental to the safe and effective operation of the Services.
6.2 Where a subscribed individual misses two (2) scheduled check calls within any single shift, the first two missed check calls shall be recorded but not charged.
6.3 From the third missed check call onwards within the same shift, a surcharge of £1.00 (one pound) per missed check call shall apply.
6.4 Missed check call surcharges are applied per individual, per shift, and reset only at the commencement of the next scheduled shift.
6.5 Surcharge charges reflect the additional operational workload placed on My Check Call’s monitoring and escalation team.
6.6 All missed check call surcharges shall be invoiced separately on the last working day of each calendar month and are payable within fourteen (14) days.
6.7 Failure to pay surcharge invoices may result in suspension of Services and referral to a third-party debt recovery provider. Statutory interest and recovery costs may be applied under the Late Payment of Commercial Debts (Interest) Act 1998.
7. Data Protection and Recording
7.1 My Check Call Limited is registered with the Information Commissioner’s Office (ICO) as a Data Controller.
7.2 Personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018.
7.3 Call Recording
7.3 ALL calls made to or from My Check Call, including check calls, escalation calls, and communications with the operations team, are recorded for operational, training, compliance, monitoring, and evidential purposes.
7.4 Personal data may be disclosed to emergency contacts or authorities where reasonably necessary to fulfil the Services or comply with legal obligations.
8. Confidentiality
8.1 All Customer information is treated as confidential and handled in accordance with applicable data protection laws.
8.2 Disclosure is limited strictly to operational necessity or legal requirement.
9. Service Availability and Force Majeure
9.1 Continuous availability of the Services is not guaranteed.
9.2 My Check Call shall not be liable for any delay, interruption, or failure of service caused by events beyond its reasonable control.
9.3 During such events, My Check Call shall be deemed to have satisfied its contractual obligations.
10. Limitation of Liability
10.1 The Customer expressly acknowledges the limited and non-emergency nature of the Services.
10.2 To the fullest extent permitted by law, My Check Call Limited shall not be liable for indirect, consequential, or economic loss, or for injury, death, or loss arising from missed check calls or reliance on the Services.
10.3 My Check Call’s total liability shall not exceed the subscription fees paid in the three (3) months preceding the claim.
10.4 Nothing in these Terms excludes liability for death or personal injury caused by gross negligence or fraud.
11. Suspension and Termination
11.1 My Check Call may suspend or terminate the Services immediately for non-payment, non-compliance, or breach of these Terms.
11.2 Data shall be retained only as required by law following termination.
12. Complaints
Complaints should be submitted to info@mycheckcall.com and acknowledged within five (5) working days.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Exclusive jurisdiction lies with the courts of England and Wales.
14. Amendments
My Check Call Limited reserves the right to amend these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
